The Bharatiya Nyaya Sanhita (BNS) 2023 came into force on July 1, 2024, replacing the 163-year-old Indian Penal Code (IPC), 1860. For judiciary exam aspirants — whether targeting PCS-J, APO, or Civil Judge positions — mastering the BNS is now the most critical aspect of preparation. Questions on BNS have already appeared in judiciary exams conducted after July 2024.

New Provisions in BNS 2023 — Not in IPC
1. Organised Crime (Section 111)
BNS 2023 introduces for the first time a specific provision on organised crime — activities conducted by a crime syndicate. Previously, organised crime was dealt with only under MCOCA (Maharashtra) and similar state laws. BNS 111 applies to:
- Kidnapping for ransom
- Extortion
- Land grabbing
- Contract killing
- Cybercrime committed by organised groups
Punishment: Death or life imprisonment with fine if death caused; 5 years to life in other cases.
2. Terrorism (Section 113)
BNS 2023 incorporates terrorism offences under Section 113. Previously, terrorism was governed by UAPA (Unlawful Activities Prevention Act) only. BNS 113 provides: Punishment = Death or life imprisonment + property forfeiture.
3. Community Service as Punishment (Section 4)
For the first time in Indian criminal law, community service is introduced as a form of punishment for minor offences. This is a significant reform aligning India with global practices.
4. Trial in Absentia (Section 356 BNSS)
BNS allows trial to proceed even when an accused absconds after charges are framed — ensuring justice is not delayed by deliberate absence.
5. Zero FIR
BNS formalises the concept of Zero FIR — filing an FIR at any police station regardless of jurisdiction, which is then transferred to the appropriate station.

Frequently Asked Questions — BNS 2023 for Judiciary
Is BNS tested in judiciary exams conducted in 2025?
Yes. All judiciary exams conducted after July 1, 2024 test the new criminal laws — BNS, BNSS, and BSA — instead of the old IPC, CrPC, and Evidence Act. Aspirants must now prepare from the new acts. Most judiciary coaching institutes have updated their material, and CLAT/judiciary-focused books covering BNS are now widely available.
How is BNS sedition provision different from IPC 124A?
IPC Section 124A (Sedition) was repealed. BNS 2023 replaces it with Section 152 titled “Acts endangering sovereignty, unity and integrity of India.” The new provision focuses on armed rebellion and incitement to secession rather than broad “disaffection” against government — a more narrowly defined offence. However, the practical scope and potential for misuse are still debated.
What is community service punishment in BNS 2023?
Community service is introduced as a new form of punishment under Section 4 of BNS 2023 for petty offences. Instead of imprisonment, a convicted person may be required to perform unpaid work for the community — such as cleaning public spaces or working at hospitals. This aligns India with global restorative justice practices.
